1. Agreement to Terms
By accessing x-funity.com or downloading, installing, or using any mobile app published under the XFunity account (together, the "Services"), you agree to these Terms of Use ("Terms"). If you do not agree, do not use the Services.
2. Eligibility
You must be legally able to accept these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.
3. License and App Store Terms
Subject to these Terms, XFunity grants you a limited, non-exclusive, non-transferable, and revocable license to use the Services for your personal, non-commercial use, unless otherwise stated in an app.
If you download an app through an app store (such as the Google Play Store), your use is also subject to the applicable store terms and policies.
4. Prohibited Activities
You agree not to engage in any of the following prohibited activities:
- Using the Services in violation of any applicable law or regulation.
- Interfering with or disrupting the Services, including attempting to bypass security or access restrictions.
- Reverse engineering, decompiling, disassembling, or otherwise attempting to discover the source code of any app, except to the extent such restriction is prohibited by law.
- Using any automated system, including "bots" or "spiders," to access the Service in a manner that sends more request messages to the servers than a human can reasonably produce.
5. In-App Purchases and Subscriptions
If an app includes in-app purchases or subscriptions, they are processed by the app store (such as Google Play) and are subject to the store's terms. XFunity does not handle your payment card information.
6. Intellectual Property
The Services, including all content and materials provided by XFunity, are owned by XFunity or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works except as expressly permitted by these Terms.
7. Third-Party Services
The Services may use or link to third-party services (for example, app stores, advertising networks, or analytics providers). Third-party services are governed by their own terms and privacy policies, and we are not responsible for them.
8. Termination
We may suspend or terminate your access to the Services immediately, without prior notice or liability, if you breach these Terms or if we discontinue the Services. Provisions that by their nature should survive termination will survive, including intellectual property ownership, disclaimers, and limitations of liability.
9. Disclaimers
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. XFunity makes no warranties, expressed or implied, and hereby disclaims all other warranties. In no event shall XFunity be liable for any indirect, incidental, special, or consequential damages arising out of the use or inability to use the Service.
10. Limitation of Liability
To the maximum extent permitted by law, XFunity's total liability for any claim relating to the Services will not exceed the amount you paid to XFunity for the Services in the 12 months before the event giving rise to the claim, or USD $10 if you paid nothing.
11. Changes to the Services or Terms
We may update the Services and these Terms from time to time. If we make material changes, we will update the "Last updated" date above. Your continued use of the Services after changes become effective means you accept the updated Terms.
